Loyalty Rewards Program Conditions

Welcome to the MacGameStore Rewards Program ("Program")! The following terms and conditions, which include and hereby incorporate the Privacy Policy and Terms & Conditions are a binding legal agreement between you and MacGameStore.com, its subsidiaries and affiliated companies ("MACGAMESTORE.COM") that govern your use of (i) the Rewards Program, and (ii) the Wallet ((i) and (ii) collectively, the "Service"). The Service is not intended for use by children under 14 years of age.

Please read these Terms carefully because they govern your access to and use of our Services and set forth the legally binding terms for your use of our Services.

1. TERMINOLOGY. The following terminology will be used throughout this document:

2. PROGRAM START. The Program will automatically begin with your first purchase after the date the Program was launched as a Service of MACGAMESTORE.COM (July 8, 2013). Any and all activity that grants Points will begin to do so only after the Program has begun for your Account.

3. POINTS CHART. All points are granted on actions on or after "Program Start". Points for prior purchases will not be available retrograde. For all points that are granted in regards to a "Purchase", that "Purchase" must have been made with MACGAMESTORE.COM.

4. TIERS. There are two Tiers for Program members: "Silver" and "Gold". All member accounts are granted the Silver Tier. After reaching $250 (USD) confirmed spent within the calendar year, the Gold Tier will be achieved. Your account will remain on Gold Tier for the remainder of the year you qualify, plus 12 months.

5. POINTS TERMS.

• Points are granted for game purchase amounts after discounts, but before taxes and wallet applications.
• Points are calculated at time of purchase, which includes any possible bonus points.
• Points are applied to account when purchase is fulfilled.
• Points for pre-orders are applied to account when pre-order has been released and purchase is fulfilled.
• Points are not earned from purchasing gift cards.
• Points are not earned from claiming a gifted game.
• Points may have other restrictions by action.
• Points have effective dates which denote when they are available for earnings (dates and times in PST).
• Points may be gained and active for both stores.
• Points are not insured.
• Points may be revoked during purchase returns.
• Points may be revoked after investigations and conclusions of member abuse of the system.
• No warranties or guarantees expressed or implied on Points or Game Cash.

6. REWARDS TERMS.

• Game Cash is redeemed automatically by the system at the member's designated rewards setting choice.
• Game Cash will expire 14 days after account has been inactive (not signed into) for 6 months.
• Game Cash cannot be applied to prior placed pre-orders, back orders or orders on hold.
• Game Cash may be gained and used for both stores.
• Game Cash rewards are not insured.
• No warranties or guarantees expressed or implied on Points or Game Cash.

7. RIGHT TO CONTEST. If you believe there is a time where the System should have granted you Points, but it did not; you may write in with a detailed explanation of the situation and Points you believe are missing. Only upon investigation and confirmation will Points be applied to your Account. Wrongfully filing multiple claims may be grounds for Program participation termination.

8. TERMINATION. MACGAMESTORE.COM may terminate or suspend any and all Programs, without prior notice or liability, if you breach any of the terms or conditions of this Agreement, the EULA, or Account TOS. Upon termination of your Program, your right to Points and Rewards will immediately cease. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.

9. MODIFICATION. MACGAMESTORE.COM reserves the right, at its sole discretion, to modify, discontinue or terminate the Program, including any portion thereof, on a global or individual basis, or to modify these Terms or Policies, at any time and without prior notice. If we modify these Terms, we will post the modification on or in our Services or otherwise provide you with notice of the modification. We will also update the Last Updated of these Terms. By continuing to access or use our Services after we have posted a modification to these Terms or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using our Services.
